By accessing or using FirstHomeGuide.ca (the “Site”), you agree to these Terms of Use. If you do not agree, please do not use the Site.
1. About the Site
FirstHomeGuide.ca is a free educational resource for Canadian first-time home buyers, operated by LendCity (FSRA Brokerage Licence #12728) under Mortgage Architects. Content is provided for general informational purposes only.
2. Not financial, legal, or tax advice
Nothing on the Site constitutes financial, legal, tax, mortgage, real estate, or investment advice. Calculators and tools use general formulas and assumptions and do not account for your personal circumstances. Always consult a licensed professional before making a home-buying, financial, legal, or tax decision. See our full disclaimer.
3. Accuracy and updates
We make reasonable efforts to keep content accurate and up to date with Canadian federal, provincial, and territorial rules. Programs, rates, tax rules, and CMHC premiums change frequently. We do not warrant that all content is current, complete, or error-free. Confirm details with the relevant government body or a licensed professional before acting.
4. Acceptable use
You agree not to:
- Use the Site for any unlawful purpose or in violation of any applicable law.
- Scrape, harvest, or mass-download content other than through our RSS feed,
/llms.txt, or/sitemap.xmlendpoints. - Attempt to gain unauthorized access to any part of the Site, its servers, or related systems.
- Introduce malware, run denial-of-service attacks, or otherwise interfere with the Site.
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity, when submitting a form or booking a call.
- Use the Site’s email-sending features (e.g., “share this article”) to send spam or unsolicited commercial messages.
5. Intellectual property
All content, branding, logos, and original graphics on the Site are the property of FirstHomeGuide.ca, LendCity, or their respective licensors, and are protected by Canadian and international copyright and trademark law. You may link to pages on the Site and quote short excerpts with attribution. You may not republish substantial portions of the Site without written permission.
6. Third-party links
The Site links to government pages, lender sites, and other resources operated by third parties. We do not control and are not responsible for the content, accuracy, or privacy practices of those sites.
7. Booking a call
Booking a call through the Site connects you with a licensed mortgage professional at LendCity. Calls are complimentary and come with no obligation. Any subsequent mortgage application or agreement is governed by separate terms provided by LendCity at that time.
8. Disclaimer of warranties
The Site is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy.
9. Limitation of liability
To the fullest extent permitted by law, FirstHomeGuide.ca, LendCity, and their contributors are not liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of the Site or reliance on any content. Our total aggregate liability for any claim relating to the Site is limited to CAD $100.
10. Indemnification
You agree to indemnify and hold harmless FirstHomeGuide.ca, LendCity, and their affiliates from any claim, loss, or expense (including reasonable legal fees) arising from your misuse of the Site or breach of these Terms.
11. Governing law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles. You agree to the exclusive jurisdiction of the courts of Ontario for any dispute arising out of or relating to these Terms or the Site.
12. Changes to these Terms
We may update these Terms from time to time. The “Last updated” date at the top of the page reflects the most recent change. Continued use of the Site after changes take effect constitutes acceptance of the revised Terms.
